Quebec

In Quebec, battery regulations were expanded in 2022 to cover battery-powered products that contain built-in  batteries weighing less than 5 kg  (see section 29, CQLR c. Q-2, r. 40.1). Section 3 outlines that obligated products covered by the regulation include, but are not limited to:

  • Personal Care & Wellness
  • Home Safety (e.g. Smoke and Carbon Monoxide Alarms, etc.)
  • Portable Lighting
  • Tools & Equipment
  • Toys
  • Drones
  • Personal Transport (e.g. E-Bikes, E-Scooters, etc.)

Under this regulation, you may be an obligated party in Quebec if one or more of the following apply:

  • You are the brand holder (owner or licensee) of regulated battery-powered products with built-in battery marketed in Quebec and you are a resident or have establishment in Quebec.
  • You manufacture regulated battery-powered products with built-in batteries and market them in Quebec under your own brand, and you are a resident or have establishment in Quebec.
  • You sell or distribute regulated battery-powered products with built-in batteries under your own brand name in Quebec, and you are a resident or have establishment in Quebec.
  • You are the first supplier or importer of regulated battery-powered products with built-in batteries into Quebec for sale, distribution or direct use in Quebec, where the brand owner or manufacturer is not resident or does not have establishment in Quebec.
