Extended Producer Responsibility in Canada

Extended Producer Responsibility (EPR) regulations shift the responsibility for waste management and environmental sustainability to producers.

In Canada, where regulations are in place, manufacturers, retailers, distributors and other suppliers of certain products must participate in an approved program.

You may be obligated to participate in a battery recycling stewardship program if you:

  • Manufacture
  • Sell (in-store, online or via catalogue sales)
  • Distribute
  • License or
  • Import

batteries, in provinces with regulations.

Take the “Am I Obligated” assessment below to determine if you are obligated in each province. Regulations determine the obligated party based on a descending hierarchy. Use the following guidelines to determine if you may be obligated.

Am I Obligated?

British Columbia

You may be an obligated party in British Columbia if one or more of the following apply:

  • You manufacture batteries and distribute or sell your product in British Columbia under your own brand name
  • You sell or distribute batteries in British Columbia under your own brand name, even if you are not the manufacturer.
  • You are an importer, retailer, or broker who sells batteries directly to end-users in British Columbia, whether in-store, online, or via catalogue sales.

Manitoba

You may be an obligated party in Manitoba if one or more of the following apply:

  • You manufacture batteries in the province of Manitoba.
  • You sell or distribute batteries in the province of Manitoba, whether in-store, online, or via catalogue sales.

Nova Scotia

You may be an obligated party in Nova Scotia if one or more of the following apply:

  • You are the owner or licensee of intellectual property rights to batteries sold, offered for sale or otherwise distributed in or into Nova Scotia.
  • You manufacture or distribute batteries sold, offered for sale, or otherwise distributed in or into Nova Scotia.
  • You sell batteries in the province of Nova Scotia, whether in-store, online, or via catalogue sales.
  • You import batteries for resale in Nova Scotia.

Ontario

You may be an obligated party in Ontario if one or more of the following apply:

  • You are the brand holder (owner or licensee) of batteries sold in Ontario and you are resident in Canada.
  • You import batteries into Ontario and you are resident in Ontario.
  • You sell or distribute batteries in Ontario, and you reside in Ontario.
  • You sell or distribute batteries in Ontario, regardless of where you reside.

You may be an obligated party in Prince Edward Island (PEI) if one or more of the following apply:

  • You manufacture batteries for sale in PEI
  • You distribute batteries into PEI, whether in-store, online, or via catalogue sales.
  • You import batteries into PEI for sale in PEI.

Quebec

You may be an obligated party in Quebec if one or more of the following apply:

  • You are the brand holder (owner or licensee) of batteries sold in Quebec and you are resident in Quebec.
  • You manufacture batteries (or devices that contain batteries) and distribute or sell your product in Quebec under your own brand name and you are resident in Quebec.
  • You sell or distribute batteries (or devices that contain batteries) in Quebec under your own brand name, and you are resident in Quebec.
  • You import batteries (or devices that contain batteries) into Quebec for direct use or resale in Quebec.

Saskatchewan

You may be an obligated party in Saskatchewan if one or more of the following apply:

  • You manufacture, distribute, or are the owner or licensee of intellectual property rights to batteries that are sold in Saskatchewan and you are resident in Saskatchewan.
  • You sell batteries to consumers in Saskatchewan but reside outside of Saskatchewan.
  • You import batteries for resale in Saskatchewan.
  • You purchase batteries from outside of Saskatchewan for use in business or institutional operation in Saskatchewan.
